Public consultation on proposed amendments to the Poisons Standard in relation to nitrous oxide – Joint ACMS-ACCS #45 – November 2026

When a scheduling application or proposal is made, they are considered by the person to whom the Secretary of the Department of Health, Disability and Ageing has delegated decision making responsibility. The Delegate may seek advice from the Advisory Committees. Where a proposal is referred to an Advisory Committee, the Delegate must invite public submissions on the proposal. The referral process to the Advisory Committees usually includes two opportunities for public consultation; one at the pre-meeting stage and one in response to the delegate’s interim decision. Further consultation can be sought prior to the making of a final decision.

What will happen

Any public submissions received are considered by the Delegate along with advice from the Advisory Committees before they make a final decision.

All public submissions will be published on the TGA website at Public submissions on scheduling matters, unless marked confidential or indicated otherwise in the submission information (see Privacy and your Personal information).

Public submissions are an important part of the process for amending the Poison Standard and are published on the TGA website using the consultation hub. Submissions by the public may not reflect the views of the Department of Health, Disability and Ageing or the TGA. Published submissions should not be taken as being endorsed by the Department or the TGA.

Following consideration of public submissions received before the closing date, decisions on the proposed amendments will be published as final decisions on the TGA website.
